Court to decide on 25 July

SIBU - The High Court here will deliver its judgement on 25 July on the interlocutory injunction sought by an oil palm plantation company after three days of proceedings.

The injunction was to stop the defendants, Anchih ak Buap and four others, from interfering with the development of Lot 11, Buloh Land District in Balingian. The development of the said parcel of land was carried out by the plaintiff, NovelPac Puncakdana Plantation Sdn Bhd for oil palm related activities.

The company is represented by Messrs Arthur Lee, Lin & Co while the defendants by Messrs Sandhu & Company. The proceeding was heard before Justice Clement Allan Skinner in his chambers.

According to a reliable source, the company was granted a provisional lease by the Land and Survey Department (LSD) to develop 3,720 hectares of land.

The source said an Environment Impact Assessment (EIA) report carried out by Sarona Sdn Bhd in May last year confirmed that the NCR land was not included in Lot 11 alienated for the plantation project.

An investigation by Land & Survey Department, the source said, was also carried out in 1997 which excluded the NCR land. The area of alienation was only approved at 3,720 hectares out of the 5,000 hectares the company had applied.

It said the injunction only involved five defendants representing five longhouses and did not involve nine longhouses as earlier claimed by certain quarters.
